Resolved Question: neighbor leaves unsigned letter on door?
Someone put an unsigned typed letter on my door in the afternoon. The very cryptic letter was put on our door with scotch tape, intentionally leaving it there for anyone and everyone to see. It’s dark black boldface type so it was intended to be noticeable from a distance. It was not in an envelope and it was not folded up so that only the homeowner could read it. I did not see who left the letter, but someone took the time to type out an unsigned letter rather than contact the association. We live in an HOA community. I went out to the common area in the early evening with my son to see what the letter was referring to. We found a single branch from a tree ( not that large but medium sized) and a small pile of what appears to be cuttings and twigs mixed with Spanish moss that were gathered and placed a few feet back from our fence. I did not put the branch back there, nor did I put together a pile of branches from any tree or trees from the common area. It appears the branch was placed there and did not fall judging from the angle. It's parallel to the fence and right behind it no more than 1 ft. Just so you won’t think the common area behind our house is a small area let me tell you that it’s really more of a greenbelt. There are quite a few trees in that area. Lots of various varieties of trees , leaves, twigs and Spanish moss as you would expect in a woodland environment. We don’t maintain the common area behind our fence, but we certainly don’t use it as a dumping ground either as this unidentified person has inferred in this letter. We don’t have control over the where the leaves fall from our trees or any branches that it might drop into the common area or on to a neighbors property. We also don’t have control over what falls “into” our yard from the trees in the common area or from our neighbors trees, and they do fall into our yard as well. My next door neighbor and I have spoken about branches and twigs that fall from my camphor tree on to her property since the tree is between our properties. I told her to pick up any branches or twigs that fall from my camphor tree and drop them back over the fence when she finds them if she did not want to dispose of it herself, and I would collect them as I collect my own. It’s a simple solution and I assume this is what she has been doing. We have no issues between us that we cannot openly discuss and as far as I know we are on good neighbor terms. If someone else wants to maintain the common area or greenbelt behind our homes they are free to do so, and it’s wonderful that they have taken on that obligation upon themselves in helping with the upkeep of the common areas. They are not free to put up an opened and unsigned letter implying that we are intentionally dumping these branches and twigs in the common area taped to our front door. The sole intent and delivery method of the letter was to harass, annoy and to hold us up to public ridicule. The writer did not sign it because they know the allegations of dumping are unfounded and untrue. Can I sue for Libel if I find out who put the letter on my door? There is libel by inference. That's a legal definition of writing a letter and inferring something. Just the fact that they didn't sign it shows they are not sure that I am dumping. Actually, they know I am not but there intent is to harass, annoy and hold me to public ridicule. The reason for the public ridicule is that the letter was noticable from the street, in boldface type and meant to be read by everyone. It would also be unreasonable for me to know what tree branches belong to me and what belongs to other trees in the common area.
