So they will have to get their own lawyers. - Even if case is removed to federal court, US law allows State trial to resume. - Even if defendent appeals, the case is remanded back to the State court for retrial. -The appeals process takes years and by the time they get out of prison, the case will never reach the Supreme Court. Law was signed by Governor and goes into effect on July 1, 2010. Only federal laws that are PURSUANT to the Federal Constitution are the Supreme Law of the land.  more

The Hill reports that while Nelson credited Nebraska’s governor for giving him the idea to lobby for the government preference, Nebraska’s governor assailed the payoff: “Nebraskans did not ask for a special deal, only a fair deal,” Heineman said in a statement Sunday. In response, Nelson fired off a letter Sunday to Heineman saying he’s prepared to ask that the provision covering Nebraska’s Medicaid share “be removed from the amendment in conference, if it is your desire.” 2. New England’s Special Syrup. Vermont and Massachusetts will get similar (though less generous) special treatment by the feds in covering Medicaid expansion costs. Combined with Nebraska’s tab, the exclusive clique’s payoffs will cost taxpayers $1.2 billion over 10 years. At least. 3. A $100 million item for construction of a university hospital was inserted in the Senate health care bill at the request of Sen. Christopher Dodd, D-Conn., who faces a difficult re-election campaign, his office said Sunday night. 4. “Some insurers are more equal than others” tax exemption. The WSJ reports that nonprofit insurance companies will be exempt from a new, nearly $7 billion tax to pay for Demcare. Democrat Sens. Ben “Blank Check” Nelson and Carl Levin of Michigan pushed hard for the tax exemption, which will exempt insurers in their states. 5. The Frontier freebie. Several lucky states will see an increase in Medicare payments to hospitals and doctors, the NYT reports, — “where at least 50 percent of the counties are ‘frontier counties,’ defined as those having a population density less than six people per square mile. And which are the lucky states? The bill gives no clue. But the Congressional Budget Office has determined that Montana, North Dakota, South Dakota, Utah and Wyoming meet the criteria.” 6. More Democrat hospital bennies. Also via NYT: “Another provision of the bill would increase Medicare payments to certain “low-volume hospitals” treating limited numbers of Medicare patients. Senator Tom Harkin, Democrat of Iowa and chairman of the Senate health committee, said this ‘important fix’ would help midsize Iowa hospitals in Grinnell, Keokuk and Spirit Lake. Another item in Mr. Reid’s package specifies the data that Medicare officials should use in adjusting payments to hospitals to reflect local wage levels. The officials can use certain new data only if it produces a higher index and therefore higher Medicare payments for these hospitals. Senate Democrats said this provision would benefit hospitals in Connecticut and Michigan.” 7. Bernie Sanders’ socialized medicine sop. He wanted a public option. Instead, he got socialized medicine satellite clinics funded to the tune of at least $10 billion. In his remarks early this morning before the cloture vote, he gloated about the funding as a crucial step toward universal care. 8. Three states – Pennsylvania, New York and Florida – all won protections for their Medicare Advantage beneficiaries at a time when the program is facing cuts nationwide.” And you know there are many more untold payoffs — paid by stealing your money — yet to be stuffed into this bureaucratic monstrosity.  more

Key Senators May Rebuff Obama on Health Care Oct 22, 6:49 AM (ET) By CHARLES BABINGTON WASHINGTON (AP) - The Democrats' control of a hefty majority in the Senate - plus the House - would suggest that President Barack Obama is within reach of overhauling the nation's health care system this fall. But the numbers mask a more complicated reality: Obama and Democratic leaders have modest leverage over several pivotal Senate Democrats who are more concerned about their next election or feel they have little to lose by opposing their party's hierarchy. One is still smarting from being forced to abandon next year's election. Another had to leave the Democratic Party to stay in office. And some are from states that Obama lost badly last year. These factors will limit the president's ability to play his strongest card - an appeal for party loyalty and Democratic achievement - in trying to muster the 60 votes his allies will need this fall to overcome a Republican filibuster in the 100-member Senate. When lawmakers face a tough vote, their uppermost thought is "survival," said Alan Simpson, a Wyoming Republican who spent three terms in the Senate. On a very few occasions, Simpson said, then-President George H.W. Bush asked him to cast a vote likely to cause him political problems back home. That was perhaps three times in 18 years, said Simpson, who held a GOP leadership post. "I swallowed hard and went over the cliff," he said. But it's a sacrifice that presidents and party leaders should not count on, he said. The Democratic leaders' limited leverage will complicate the push for allowing the government to sell insurance in competition with private companies. Some Senate Democrats who oppose the idea are from states that voted heavily against Obama last fall. Democratic Sen. Blanche Lincoln faces a potentially tough re-election race next year in Arkansas, where Obama lost to Republican John McCain by 20 percentage points. She says she will base her health care votes on what is best for Arkansans. Choice and competition among insurers are good, Lincoln said, but "I've ruled out a government-funded and a government-operated plan." Sen. Mary Landrieu of Louisiana, where Obama lost by a similar margin, said she might be willing to let some states try "fallback or trigger" mechanisms that would create a public option if residents don't have enough insurance choices. But she told reporters, "I'm not for a government-run, national, taxpayer-subsidized plan, and never will be." Another Democratic senator, who also may prove wary of Obama's overtures, takes the opposite stand. "I would not support a bill that does not have a public option," said Sen. Roland Burris, D-Ill. "That position will not change." Burris' willingness to bend could prove crucial this fall if Obama and Senate Majority Leader Harry Reid, D-Nev., need every possible vote in crafting a compromise, such as a national public option that is triggered if certain insurance availability targets aren't met. But Burris may be in no mood to play ball. Obama and other top Democrats sharply criticized his appointment to the Senate in December by an ethically tainted governor, Illinois' Rod Blagojevich, and they forced Burris to abandon hopes of winning election in 2010 by making it clear they would not back him. In short, Burris, 72, has virtually nothing to lose by defying his party's leaders and voting as he pleases. Sen. Joe Lieberman of Connecticut is another potentially crucial senator with tenuous ties to the Democratic Party's hierarchy. Rejected by Connecticut's Democratic voters in the 2006 primary, he kept his Senate seat by running as an independent. He now calls himself an Independent Democrat. Lieberman has criticized the health care bill that emerged from the Senate Finance Committee, but it and other health bills are undergoing changes. Another centrist Democrat whose vote is uncertain is Sen. Evan Bayh of Indiana, a political battleground state. "I want to know what works for families and small businesses," said Bayh, adding that he might back public insurance options run by states, not the federal government. It's possible that Obama and party leaders eventually will ask Democrats such as Bayh, in the name of party loyalty, to vote to block a GOP filibuster of a health bill even if they plan to vote against the bill on final passage. The strategy might enable Democrats to muster the 60 votes needed on a crucial procedural question and then pass the bill with a simple majority. Bayh said that if a party leader "is asking some of us to enable the passage of legislation that we think would be harmful to the people of our state, I don't think that's a fair thing to ask." It's possible that centrist Democrats are holding out for favors from Obama and party leaders, such as pet projects for their states or help in their next campaign. On January 5,1925 , the first woman governer, Nellie Ross, was inagurated in Wyoming, Would you like to be the governer of your state? Why ot why not? Complete your answer in axxpomitley one half ofa page at a 12 point Font. I started like this: No I would not like to be the governor of my state. I’ve gotten much too use to the civilian life and I would not like to deal with all the responsibilities of being the governor of my state. There’s much too much to worry about, such as politics, laws, elected officials and making the population of my state happy. I’m sure that getting to have such power and such a say in what’s going on in my state would be a great feeling indeed. Resolved Question: Why do people believe that Hitler was a Christian?

I mean no disrespect at all towards anyone- please bear this in mind. I have encountered some Atheists (and some non-Atheists) here on 'answers' who, ostensibly, believe that Hitler was a Christian. This has resulted in a great deal of bemusement on my part. Atheists are, by and large, highly intelligent people, capable of independent thought and critical thinking. They are not typically gullible individuals. Dare I say it, Atheists are seemingly more erudite and literate than a majority of Christians that I have known. I mean no disrespect at all towards my fellow believers. There are many Christians that are highly intelligent. Hitler evidently did claim that he was a Christian. But does that make it so? If I claim to be the governor of Wyoming, does that make it an incontrovertible fact? If some fellow from Iraq claims to be Jesus, does that automatically make the assertion true? I do not think that Hitler was a Christian. Neither do I believe he was an Atheist. I do not know how to even classify that man. I just know that he was extremely evil. Do we see Billy Graham, for example, going around committing genocide? What about Mother Theresa- did she ever commit murder? Ghandi was a good man. He was pacifist. He was sort of Christlike in a way, because Jesus himself was a pacifist. Does Hitler honestly sound like he was a pacifist? The main problem I have with anyone calling Hitler a Christian is the negative associations that it has with Christendom. To say that Hitler was a Christian is to classify Christians as insane murderers. Yes, I know about the crusades and the inquisition. It also says in the Bible "Thou shalt not kill." I think that it is also unfair for anyone to call Hitler an Atheist, because, once again, it throws all Atheists into a horrible category. I cannot say that 'religion' Hitler was. But from what I gather, he was heavily into the occult. I will let you draw your own conclusions as to what that may mean. If you examine Hitler's actions, you will also conclude that his actions were not that of a typical Christian. To be sure, his actions were not that of a typical human being at all. His actions were not that of a typical Atheist, either- for I have discovered that many Atheists are really good hearted people, who care about life and people. Believe whatever you wish. But please just bear in mind that in the real world, sometimes people have ulterior motives. Things are not always as they seem. People can make claims all they want to- but by examining his or her actions, we can ascertain the truth. Agree? Disagree? Comments? Hey Dreamstuff- good counterpoint: but incorrect, I'm afraid. Resolved Question: What can I say to people to support Barack Obama? I am fairly conservative, but think McCain-Palin disaster.?

I originally was a strong supporter of Ron Paul for President. Conservative and reasonable politicians, such as former Wyoming Senator Alan Simpson said McCain was impossible to deal with. McCain clearly has a militaristic approach, when America needs to use diplomacy as an option. He called people who make $5 million a year middle class. McCain has voted against tax cuts. The media is going head over heels over Sarah Palin. McCain could have picked a competent woman such as Senators Kay Bailey Hutchison or Elizabeth Dole and it would have made have second thoughts about whom to vote. No matter how much the media finds her appealing it is scary that a governor of Alaska for 2 years is a hearbeat from the presidency with the 72 year-old McCain, who is not strong in health. How can I make the case the Sen. Obama will produce real change? What could I say to conservatives to comfort them that Obama will not give us too big government, is not liberal? The election is turning into a circus and want some good brief talking points for Sen. Obama in campaigning. I think he is pragmatic and will have capable around him. McCain is erratic and is capable of doing and saying almost anything; completely unprincipled. Has a very bad temper and it could erupt and cause a serious problem with Congress or in foreign policy. Barack Obama is steady. Any ideas about how to convey this to potential voters? Unfortunately, we are in an era of sound bites, and door to door campaigning or calling does not give one much time. Suggestions from readers would be tremendously appreciated. I care about this country. I genuinely have an open mind. The arugments against Obama include how he put his foot in his mouth after Gov. Palin reference to lipstick on a pig, he should not have used the phrase. Obama does support a costly and impractical Global Poverty Act to end poorness worldwide. He was a member of a church that had a radical anti-American Rev. Jerimiah Wright. He has not distinguished himself in the U.S. Senate. It would appear he would have the government too involved in our economy and lives. Also, I do not see in foreign affairs that he would bring real change. I have read his "Blueprint for Change." Although McCain appallls me, I simply cannot go door to door asking people to vote for Barack Obama. I asked the question sincerely to help me decide what to do. Probably will campaign and follow this circus little. I did consider all comments. The only candidate I see offering real change is Bob Barr, whom I will vote and perhaps campaign for. Favorites: 1. TEXAS. My adopted home. Great genuine people, diversity in cultures and geography, Texas pride, the most beautiful women I've ever seen! 2. Louisiana, my native home. I love my family there, and it is a culture and region distinctly its own (even if it does have an idiot for a governor.) 3. Wyoming. Wide open spaces and awe-inspiring views only God could have made. The most laid-back people I've ever met. 4. Tennessee does sound good to me. It has charming small towns, beautiful mountains, and friendly but growing metropolises. Rocky Top! Least favorite: 1. Oregon. BEEAUTIFUL STATE, but that's it! I would be just as depressed as those people if I lived in rain 550 days of the year. 2. Kentucky. More rayed-neyck than many places. Rude and cliquish natives, very little to do, some of the rudest clients I deal with in my job come from KY. At least it has nice farms. 3. West Virginia: Been there once, scared the h*ll out of me. <Think dueling banjos>  more
