Resolved Question: What is the best study prep book, class, etc. for trying to get into law school?

I'm at a career change and I am going to try to get into law school in Houston, Texas. I only have three options; UH Law Center, Thurgood Marshall and South Texas. I have a BS in Environmental Chemistry, but I've been out for ten years. My undergrad grades were not the best, so I need to do good on the LSAT, I'm also not a genius, so I need a class, book or whatever that is easy to understand. Also, I'm very interested in the Real Estate Law arena, any advice would be appreciated. Thanks.  more

Resolved Question: Teacher seeking New Home Sales career in Houston, TX?

I would like to work as a New Home Sales Consultant in Houston. A real estate license is not needed in Texas to work for a home builder, however I have two out of the five required real estate courses completed. I'm wondering whether or not it would be easier for me to work as a Real Estate Agent (maybe part-time?) first to get experience than to try to get a job with a builder, given the current state of the market. How often do these builders hire people without experience? I need answers from individuals in the business please. Thanks!  more

Resolved Question: Do you believe that "Defamation is defamation no matter whether it is written on paper or on a blog,"?

HOUSTON, Texas (AFP) - A real estate agent in Houston who blogged about Anna Nicole Smith was jailed for contempt last week in a defamation case brought by the late Playboy model's mother. Legal experts said bloggers are increasingly the targets of such litigation, which are testing the bounds of free speech. Lyndal Harrington, who is accused of helping to spread falsehoods that Virgie Arthur married her stepbrother and abused Smith as a child, spent four nights in jail after she failed to comply with a court order to turn over her computer. Harrington says she is shocked that she is being sued for comments posted on someone else's blog to pass the time. "I just voiced my opinion," said Lyndal Harrington of her posts about Smith and Arthur on the website "Rose Speaks." Like many bloggers, Harrington doesn't consider herself a publisher and did not realize she could be held liable for her posts. "I got into this because my business had fallen apart in this economy and it was something to do," she told AFP. "I developed a lot of friendships with women who are retired or ill at home." "A lot of bloggers think of themselves as individuals or maybe writers but in the courts, they are considered a publisher," Cox said. His organization has created an on-line course with Harvard Law School, City of New York School of Journalism and News University at the Poynter Institute at Northwestern University to educate bloggers about their legal rights and responsibilities. "A lot of these cases could have been avoided if things had been worded just a little differently or if they had double sourced their information," Cox said. "With Google alerts and rss feeds, it's a lot easier to monitor what's being said about you," said Sam Bayard, assistant director of the Citizen Media Law Project at Harvard University. Moreover, the technology exists to find anonymous bloggers. "There's this Wild West mentality where people think they can do anything on the Web and not be held liable," said Bayard. While state laws vary on what constitutes defamation and who qualifies as a journalist and thus who can protect sources, Bayard said, judges have consistently applied the same standards to blogs as they would any other medium of expression. "Defamation is defamation no matter whether it is written on paper or on a blog," he said. http://tech.yahoo.com/news/afp/20090601/tc_afp/entertainmentusinternetmediajusticepeople  more

Voting Question: I have an Arizona real estate salesperson license, what are the requirements for a Texas real estate license?

I work for a commercial real estate company in Phoenix and will be moving to Houston in a couple of months. My current position (and future position) does not require that I have a real estate license to be able to perform any of my job functions. I am not involved in real estate sales in any shape, however being licensed is beneficial in my field. Since I am currently a licensee in Arizona, I assume I will only have to take credits and courses to cover Texas-specific real estate laws and practices, can anyone confirm this? If not, any information about the Texas licensing process would be helpful.  more

Voting Question: TREC Commercial Lease _ Repairs?

i have a TREC commercial lease in Houston, Texas. We have had a water leak in the main service line (this side of the meter) outside the building and the landlord wants us to pay for the repairs. We disagree due to the verbiage in the lease. Under paragraph 15 it states we would be responsible for repairs "in the premise". The landlord and his attorney are saying that "in" would mean anywhere on the property, not just inside the building. Has anyone had any experience with this type of problem? and yes, I am contacting a real estate lawyer.  more

Resolved Question: Does anyone know property/real estate laws in Houston or Katy Texas?

I moved into a new community in Katy, Texas 10 months ago. Upon making our decision to buy this lot, we asked our home builder if there were any plans of construction going on with the land behind it. They said "nothing that we are aware of" They just said it is commercial property and nothing else. 4 months into living here, a contractor started breaking ground for what is now becoming a 2 story concrete warehouse that is 15 feet from our back fence. It is almost as tall as the power lines that run across the back of the community and it blocks about 75% of my view from my patio. The loading dock is right behind our house. My view of our gorgeous Texas sunsets is now gone. Do I have any rights? Are there any rules or laws of disclosure that I should have been informed of? I feel extremely cheated. I chose this lot as we didn't want a 2 story homeowner overhanging our back yard. Now we have a commercial one....Any advise would be great.  more

I am a newly licensed agent in the Houston area. I have a network of Real Estate Investors that I deal with. If I have the Buyer sign a Buyer's agreement, is the Seller obligated to pay my commision? How can I prevent a Buyer from going direct to the Seller? If I have the Buyer sign the Buyer's agreement, and then the two parties do a side deal, what recourse do I have? I'm working with investor buyers who are looking for properties. I get lists of investment properties for sale from other investors or agents representing Selling investors. I normally create a spread sheet with all of the properties I get notices on. Some are through 3rd party contacts. Need advice on how to proceed and get my $$$$$  more

A few months back I found land for $10,000 in Spring Texas on e-bay, but did not have the savings back then and have had no luck finding similar values so far. Resolved Question: Relocating to Texas...Dallas or Houston?

I am planning to relocate within the next two years and Dallas and Houston are on my list of cities for consideration. I am a 35 year old, African-American, professional with a tween daughter (whose father is from Barbados so West Indian culture/community would be great). I am seeking affordable real estate, warmth (the NY winters are driving me insane!), good schools (although private school is an option), great job opportunities and a lot of the amenities that a large metropolitan area has to offer (i.e. I'm a recovering Starbucks addict, a growing Whole Foods shopper, my daughter loves the water although neither of us can swim, I'm learning to ride a sportbike, I love Japanese food and dancing to soca, reggae, R&B/NeoSoul and spoken word). That said, I'm looking for the city that can offer me at least small portions of all of those....  more
