A majority of likely voters say the federal government should take legal action against cities that provide safe havens to illegal immigrants and cut federal funds to so-called "sanctuary cities," a Rasmussen Reports survey shows. The survey, released Tuesday, said 54 percent support legal action against sanctuary cities and 60 percent support withholding federal funds from the jurisdictions. Critics of sanctuary cities say the Justice Department is acting unfairly by not pursuing such cities for breaking the law while taking legal action against Arizona for instituting state measures against illegal immigration. "The federal government should be suing San Francisco, which has refused to cooperate with the federal government in enforcing immigration laws," said Corey Stewart, chairman of the Prince William (Va.) County Board of County Supervisors. In 2007, Mr. Stewart was at the forefront of the issue, driving some of the county's toughest immigration laws. "Our belief is that President Obama should be suing mayors [of sanctuary cities], not Arizona," said Maryland state Delegate Patrick L. McDonough, Baltimore County Republican. Mr. McDonough said he plans to introduce two immigration laws during the next General Assembly session: one that calls for a state ban on sanctuary cities and another patterned after the Arizona law. A representative for U.S. Attorney General Eric H. Holder Jr. recently said a "big difference" exists between a state or locality choosing not to use resources to enforce a federal law and a state passing its own immigration policy that "actively interferes with federal law." Rasmussen found that 56 percent of those surveyed oppose the Justice Department's action against Arizona and that 61 percent favor legislation similar to Arizona's in their own state. Chicago, Dallas, Denver, Los Angeles, Miami, San Francisco and the District of Columbia are among the major U.S. cities that have adopted sanctuary ordinances, which prohibit police officers and other municipal employees from asking people about their immigration status. The program targets "the worst of the worst" and has taken criminals off the streets, ICE said. Critics say Secure Communities spreads racial profiling – an accusation the federal government denies. ICE officials say the use of fingerprints makes the effort colorblind. The use of Secure Communities has jumped as cities and counties balance conflicting political pressures. Some want to crack down on illegal immigrants. Others want illegal immigrants to report crimes or give witness statements without deportation fears. The data base is using fingerprints to check on the backgrounds of criminals, how is this profiling when every criminal is fingerprinted? I have been fingerprinted several times for jobs, how is this different? ARe they seriously not wanting these criminals deported? What is with these people not wanting to make our streets safer? The growth of the program comes as Arizona plans to start enforcing its anti-illegal-immigration law Thursday – unless a court intervenes. Secure Communities seeks those charged with such crimes as murder, rape and drug offenses with a sentence of more than one year. But only 15 percent of those who've been targeted by the program have fallen into what it calls "Level 1" offenses, according to the federal government's criteria and its data in the program's first 18 months of operation. About 35,000 people were identified nationally as charged or convicted of Level 1 offenses. And nearly 9,000 nationally were deported with Level 1 convictions. In Dallas County, 886 immigrants were charged or convicted of Level 1 offenses, and 354 with Level 1 convictions were deported. "We've processed for removal really bad guys that we have taken off the streets to keep the community safe," said Nuria T. Prendes, field office director for ICE's Office of Enforcement and Removal Operations in Dallas. In a case last August, the Dallas County Jail booked a Guatemala-born man and checked records through the two federal databases. They found he'd been convicted already of aggravated assault with a deadly weapon. He also had previous arrests on drug possession and had been deported. ICE prosecuted him with a fresh criminal charge of re-entry into the U.S. Checking fingerprints Under the program, fingerprints at a jail booking are linked simultaneously to a federal criminal history database of the Justice Department and a Homeland Security Department database. The check determines whether an arrested person has ever had contact with immigration officials. The Homeland Security's database now contains more than 100 million fingerprints. Not all of those identified under Secure Communities are illegal immigrants. The program has identified naturalized citizens and legal permanent residents. Legal residents can be deported if they are charged with some felonies. Critics say that the link to local law enforcement can allow for racial profiling. "They overlook that the program operates at the point of booking and arrest," said Sarahi Uribe, an organizer with the National Day Laborer Organizing Network. A police officer has only to arrest a person, and it can spin into a deportation, Uribe said. The "vast majority" of people picked up have committed minor offenses, she said. Her organization sued ICE earlier this year to get more information on the program's scope and its arrests. Nearly 40 alleged gang members from the Arlington and Fort Worth area were arrested last week during the U.S. Immigration and Customs Enforcement’s five-day operation that targeted foreign-born gang members and their associates, authorities said Monday. The arrests include members of at least 29 gangs in the Metroplex, including several with ties to Arlington and Fort Worth. Some 105 people, including gang members from Mexico, El Salvador and Honduras, were arrested in the sting that ended Saturday, ICE officials said. Six of those arrested were women. ICE officials have scheduled a 1 p.m. news conference in Irving to talk about the arrests. Some of the gang members were either arrested for or suspected in various crimes, including home-invasion robberies, drive-by shootings, aggravated robbery, aggravated assaults and drug possessions, officials said. Officials also seized two firearms, cash, marijuana, cocaine, methamphetamines and hydrocodone. Information collected during the sting indicates that criminal gangs are becoming increasingly involved in drug smuggling and distributing, money laundering, and other illegal activities, authorities said. Police from Fort Worth, Arlington, Dallas, Carrollton, Irving and Farmers Branch as well as the Texas Department of Public Safety, the Dallas County Sheriff’s Office and the Dallas County District Attorney's Office assisted in last week’s operations. Seventy-two people were arrested on criminal warrants or charges; 33 were taken into custody by ICE on immigration violations. DALLAS - A Dallas County jailer is facing deportation after she was arrested by federal agents while on the job Friday morning. Maria Elvia Ross, 31, is suspected of being in the country illegally, and appears to have worked for the county illegally for nearly a decade. Commissioner John Wiley Price said the news has come as a shock to those at Dallas City Hall. He also said the mistake should have been caught when Ross was originally hired with the county in 2001, which was when Jim Bowles was sheriff. "That's probably the $64,000 question," Price said. "It happened in a prior administration, you really don't know. I guess at some point in time, something always gets through the cracks." Ross had extra responsibilities and was on Sheriff Lupe Valdez's quality assurance team, which oversees improvements to sanitation. "Their job is to make sure that the jail meets all of the safety compliance standards," Price said. Price said Ross was caught when she applied for a deputy position and had to undergo a second background check. "Once you are vetted through the process, I'm sure periodically they check," he said. "But, to be able to check that many officers every day, I mean nobody does that." The commissioner said the county follows strict federal guidelines when it comes to checking immigration status, but called the Ross incident a fluke. A News 8 investigation uncovered more than 1,000 illegal immigrants were charged with serious crimes and then deported from Dallas County before their cases went to trial. Those inmates were locked up in the same jail system in which Ross was responsible for helping oversee quality control. I have been pre-approved after we found a house that we fell in love with. (we were not shopping, just came upon it and decided lets try). the house is built in 1946, single storey, 1 bath, 2 bedrooms, living room with fire place, kitchen with cabinets, electric stove, dishwasher, no refrigerator, with a small window to living room and door to back yard, dining area is medium size about (10 by 10 feet or less) and opens into a washer dryer room (neither is present). back yard is large and drops off steeply into the river. A shed is out in the back yard. Finally the garage has been converted into a room so there is no garage. I can describe much more in detail but for now 2009 Dallas county appraisal puts house about $20000 less than what the seller is asking for. Neighborhood is very small (about 4 streets) historical district, surrounded by some very low income and perhaps even higher crime neighborhood. But these streets have houses ranging from about 80 k to 220 k. Q: how do i determine a reasonable price to quote, whne I expect there is some work to be done on this house when I move in? Thanks. I am not asking you for a number that I can quote, but for ideas on how I can make a good quote. How badly I want a house: not very; how badly we want this house: we like this very much; But we do not want to cheat ourselves. Neighborhood is very small (4 streets for house sale comparisons only). so one bad sale can depress property value easily but a very good sale can pull up values in the neighborhood too.  more

This fall, a court in Houston will hold a hearing to determine if the death penalty poses an unacceptable risk of executing an innocent person. In Dallas County, Texas alone we have had over 20 individuals released from prison as a result of DNA tests which reveal that they did not commit the crimes they were convicted of - in other words, they were innocent. We know the following about the death penalty: (1) there is no evidence that the death penalty deters future crime; (2) there is overwhelming evidence that the death penalty is administered in a fashion that discriminates against minorities and the poor; and (3) it costs more to execute someone than to keep them in prison for the rest of their lives. Add to these reasons the growing number of individuals across the nation who have been released based on DNA (this means an innocent man was in jail and the true criminal was likely still at-large). In fact, we have had over 20 folks in Dallas County released based on DNA evidence. Should the United States continue to use the death penalty? Why or why not? If you were the judge in the trial in Houston his fall, how would you rule?  more

I'm a 24 year old woman with a history of cervical/vaginal dysplasia. I'm currently living in north dallas. I'm having some problems and I really need assitance. I go to a community college and work for a small business, so neither of those outlets offer me any sort of health care. I'm really nervous and need help. They are accused child rapists, drug dealers and thieves. And because of major reforms in the justice system — spurred by a News 8 investigation — those people now face prosecution. As recently as November, because of a loophole in the law, many would have simply been set free without ever going to trial. Until it was fixed, the loophole allowed for the deportation of accused criminals — and a breakdown in the justice system. We introduced you to "Sylvia" back in November. While she is an American citizen, her husband, Jose Salvador Tinajero, is Mexican. He had just been deported instead of prosecuted for molesting her two children. "There is no justice," Sylvia said last year, "especially for my girls, my family. There is none." Today, she is simply overwhelmed at the progress that's been made. News 8 first broke the story that more than 1,000 illegal immigrants who were charged with serious crimes like murder had been deported before their cases ever went to trial. Many were bused back to Mexico and simply set free across the border. In November, we spoke to Sgt. Ernesto Fierro, an investigator for the Dallas County District Attorney's office. At the time, little was being done to fix the problem, and Fierro said he was "furious" about it. Buena Valentin is a Mexican citizen charged with raping his girlfriend's seven-year-old daughter. After the attack on the girl — and her sister — they immediately ran to church for help. "She looked really bad. Very bad," said Eleuterio Cabrera of Templo de Dios. "She was crying. The girls were very, very, very bad. It was horrible." What was the problem? After an arrest, the district attorney's office was usually not notified until a case had been in the system for several weeks. In that gap of time, the accused paid his bond. Then — because the suspect was in the U.S. illegally — he was turned over to ICE, Immigration and Customs Enforcement. The job of that agency is to deport, regardless of pending charges. Now, however, because of News 8 reports, those holes in the system are all plugged, and Sgt. Ernesto Fierro has a new, full-time assignment: Keeping people like Buena Valentin in jail. "I feel great; I feel really good," Fierro said. "I feel like I've really done something here." And the 90 crime suspects in Fierro's book will remain incarcerated in the Dallas County jail until their cases are settled. "Many of them would've been on the bus back to their home country," Fierro said, without the changes to the system. Two big fixes are: •A mandatory $100,000 bond for anyone who is a flight risk due to possible deportation. About 57 percent of voters in Fremont supported the proposal, according to unofficial results that still must be certified by the election commissioner. The measure is likely to face a long and costly court battle, with the American Civil Liberties Union saying it will try to block it before it even goes into effect. The town of about 25,000 people has watched as its Hispanic population surged in the past two decades, largely due to the jobs available at the nearby Fremont Beef and Hormel meatpacking plants. The city also has an enviably low unemployment rate that matches the Nebraska rate of 4.9 percent. Nonetheless, residents worry that jobs are going to illegal immigrants who they fear could drain community resources. Proponents of the ballot measure collected enough signatures and fought in the Nebraska Supreme Court to put the question to a public vote. Supporters say the measure is needed to make up for what they see as lax federal law enforcement. Opponents say it could fuel discrimination. Trevor McClurg said the measure is fair because it's aimed at people who aren't legally in the U.S. "I don't think it's right to be able to rent to them or hire them," McClurg said. The application process will force Fremont officials to check if the renters are in the country legally. If they are found to be illegal, they will not be issued a license allowing them to rent. The ordinance also requires businesses to use the federal E-Verify database to ensure employees are allowed to work. Communities that have passed such laws have faced costly legal bills and struggled to enforce them because of legal challenges. Hazleton, Pa., passed an ordinance in 2006 to fine landlords who rent to illegal immigrants and deny permits to businesses hiring them. The Dallas suburb of Farmers Branch also has tried for years to enforce a ban on landlords renting to illegal immigrants. Federal judges struck down both ordinances, but both are on appeal. Even before the Fremont measure passed, the ACLU of Nebraska had said it would sue. "Our goal would be to bring an action to ensure that there is not even one day that the law can go into effect," said Amy Miller, legal director for the ACLU of Nebraska. A friend of mine has made some mistakes in his past, (drugs and such) but he is a very good person who relies too much on so called friends who arent good for him. He gets very depressed and needs people around him which often leads to relapses with drugs and spending time with people who deal in drugs and alchohol. He has just gotten out of jail after being there for 6 months and is now homeless, without any money or options really. He is currently staying at a salvation army shelter I believe. I know that these shelters arent often more than a roof over thier heads at night providing nothing more than a cot/mat on the floor. They also have a very strict schedule. His Parole officer is in Denton and he has no transportation. I live in the UK and can do nothing more than research for him but Im hoping to find something that will help him before he gets back into the rut that he normally falls in. I know this is a lot of information but things like this tend to get a lot of questions in return so I hope I have explained adequately enough. (I know a lot of people who have lost their lives to drugs and I hope that he doesnt end up the same, as well as my brother who has also been addicted the the stuff). Basically I need websites or phone numbers in the Dallas or Denton county areas where I can find a place for him to live where he can get back on his feet on his own. There are plenty of womens shelters and such but not so many for men. He is only 24. He needs a place to stay that can help him find a job and start earning a living, possibly someplace that has a program for those recently released from jail. My son was pulled over due to a wrong turn and was questioned and was giving a field sobriety test and passed. While being booked in jail one of two police officer (a young male) was picking on my son and they got into a verbal altercation, by the time they got to the booking area it seemed like my son was " labeled" as a trouble maker because of the P O kept on wire him up. When my son was ordered for blood to be drawn, my son refused because he is very scared of needles. My son was slammed to the ground, P O placed his knee in his back caused him a sprained back. My son was ruff handled by jailers and caused him injuries. He ask the see medical several times and never was able to speak or seen by a nurse because of him being in pain. After he bailed out, my son had to be taken to the ER for medical attention. His injuries was sprained back, knee and shoulder and multi abrasions. Who can I talk to about getting the video from the jail and see what happen to him and why excessive force was used and also if his civil right was violated? I, myself worked in a prison for over 6 years, I DO KNOW how things are. I know there is two sides to a coin, I hear my son's story, now I want to know what the jail's story is so I know why the injuries were caused to him. In both Tucson and Dallas where I have practiced medicine, hospitals are struggling under massive costs of uncompensated medical services for uninsured people who, by federal law, cannot be turned away for lack of insurance or ability to pay. How much does this uncompensated care actually cost taxpayers? The incredible answer: no one knows. We only have "estimates" of the costs to taxpayers to treat illegal immigrants because hospitals and public health clinics do not ask for proof of citizenship before providing care. What are consequences to taxpaying citizens? 1. Increased cost and reduced access to trauma care. Tucson has lost all but one Level I Trauma Center to serve all of southern Arizona, in large part due to massive, unsustainable losses from uncompensated care. Auto accidents involving overloaded vans of illegal aliens happen regularly in southern Arizona. Injured are flown by air ambulance to University Medical Center's Trauma Center and treated with state of the art care....all at taxpayer expense. 2. A registered nurse involved with the Pima County health system since the 1970's who must remain anonymous because of her role, said she has never seen any staff member at either El Rio Clinic or Pima County Health Department ask for proof of citizenship before providing free medical services (immunizations, Well Baby checks, food stamps, WIC services, birth control, and even elective abortions). Costs are paid by taxpayers. When funds are depleted, low income American citizens have fewer services and longer waits as a result. 3. This same RN also said: "I personally know Mexican men who married 16 year old girls, got them pregnant, brought them to Tucson for the baby to become a US citizen. They live in Mexico but come here for their health care. Taxpayers pay for this medical care many ways, at the Public Health Department, and with school nurses who provide care." 4. Uncompensated medical services for illegal immigrants mean higher premiums for all of us due to cost shifting among all third party payers. So I've already completed a Driver Safety course less than a year ago and got a speeding ticket in Dallas county (Carrollton) some months back but qualified for Deferred Disposition. The main requirements are to complete another Driver Safety course AND not get any tickets for a set period of time. Today I got a ticket in Tarrant county (Hurst) for merely crossing over the area on the highway that designates the highway will split because I was in the wrong lane and was about to miss my exit. I informed the officer that I was currently participating in Deferred Disposition in Dallas county and asked if this would violate that. The officer informed me that since this was in Tarrant county I would again be eligible for the Driver Safety course/Deferred Disposition. Long story short; I've read the opposite. Was he lying to me and will I now have two tickets on my record and if so is there another method of getting the sentences reduced/dismissed besides hiring an attorney?
